THE prosecution of the editors of The Masses for “conspiracy to obstruct recruiting and enlistment” is an attack on the lawful freedom of the press.

It is not an attempt to defend the country against conspirators, spies, or any other classes of criminals contemplated by those who framed the espionage law.

It is an attempt to put four American citizens in jail for expressing their lawful opinions. And it is the culmination of a series of acts which the New York Evening Post has described as “governmental persecution.”

Not one word of evidence to prove that these men ever wrote to each other, or ever discussed the subject of the draft or enlistment with each other, after the passage of the espionage law, was adduced by the government.

Not a word of direct evidence that they intended to, or wanted to, or ever even imagined or discussed the possibility that they might obstruct recruiting or enlistment.

Elizabeth Gurley Flynn, accused of complicity in I. W W. plots, waited in vain yesterday for some fairy godmother to furnish the $10,000 bail demanded for release pending proceedings which have been brought to compel her extradition to Chicago. As the hours passed a hopeful smile that she had borne upon her arraignment before United States Commissioner Samuel M. Hitchcock faded and at nightfall she was hustled into a patrol wagon and returned to her little cell in the Tombs.

She wan not alone in her misery, for the fat, prosperous looking Carlo Tresca and the swarthy Giovanno Baldazzi found themselves in a similar plight. Tresca, who is editor of an Italian anarchist organ printed in this city, had twirled his thumbs all the afternoon waiting for Amos Pinchot to come around and ball him out. Such were the expectation that he expressed, but Mr. Pinchot failed to materialize. So the pair sat opposite their queen in the patrol wagon, manacled to each other and guarded by big deputy marshals.

Only Arturo Giovannitti, versemonger for the Industrial Workers of the World, he of the flowing hair and tie, idol of the unkempt and bane of the police, was permitted to breath freedom’s sweet air. The poet was bailed out and the queen returned to her cell.

NEW YORK, Nov. 2.-“Wherever there is a big Rockefeller interest, there you find brutal slave driving methods in the treatment of underpaid workers,” declared Frank P. Walsh, chairman of the Committee on Industrial Relations, in New York, at the height of the Bayonne strike.

[Mr. Walsh continued:]

The most dangerous as well as brutal feature of the Rockefeller treatment of labor, is the close control that the Rockefeller concerns gain over the police and other public authorities. With the mayor of Bayonne confessing that he is a hired attorney for the Rockefeller interests, and with the police department using its full force, and hundreds of special deputies [deputized company gunthugs] to beat and kill the revolting strikers, the American public has its latest demonstration of what Rockefellerism means.

The New York Call (Socialist) of October 12th published a warning to the American people regarding the strike situation in Bayonne, New Jersey, from Dante Barton of the Committee on Industrial Relations:

As for the American people:

Is it not time that the American people should awaken to the essential brutality of millionaires and billionaires running their business on the principle that they cannot and will not pay their hardest-worked workers enough to give them a decent living? Ought we any longer to have business on terms in which it is considered respectable for that sort of treatment to be given to workers? The majority of these Polish workers receive now $2.50 a day, which, with the increased cost of living, does not give them enough for a profitable living.

And as for big business:

When these Polish workers have the ambition and the fine qualities to strike against that degraded condition in life, gunmen and special policemen, armed with guns and machine guns, are rushed against them, and the workers are abused because they have manhood and courage.

This sort of industrial injustice, if it is not cured and overthrown, must necessarily lead to the kind of revolutionary disorder that men like the Rockefellers and Morgans consider so terrible. Men like these are sowing the wind and they will reap the whirlwind.
